Abstract

OBJECTIVE: the analytical study of the difference that exists between the federated state and the confederations METHOD: carried out on the subject of the simple State versus the federations and confederations. RESULTS: The constitutional State of an independent and sovereign nation, entrusts a constituent assembly with the drafting of the fundamental law based on the values ​​of freedom, equality and delimitation of state power. With global development, the need arises to implement an interdependent sovereignty in search of cultural integrity, uniformity and determination of peoples with the same identity, giving rise to the federated State. Constitutional sovereignty is influenced to a certain extent in the international treaty that creates the confederation, before, contrary sensu, an absolute independence of the unitary or federative State that supports its sociopolitical order in a fundamental law. CONCLUSION: sovereignty in a federated state can only complement it, but not replace it, abrogate it or reform it; Unlike the confederation that establishes limitations to its sovereignty and reserves the exit of the confederation, it yields certain sovereignty so that the international treaty that creates it has the linkage it needs to be effective.
